IRS Provides Guidance on Drafting Charitable Lead Trusts
The IRS has added charitable lead trusts to the list of planned gifts for which it has issued sample trust instruments, annotations, and alternate provisions. This new guidance is contained in Revenue Procedure 2007-45 for inter vivos trusts and Revenue Procedure 2007-46 for testamentary trusts. Each Revenue Procedure covers both grantor and non-grantor charitable lead trusts.
